Understanding LCAs and H-1B Visas
Before an employer can file an H-1B petition with USCIS, they must submit a Labor Condition Application (LCA) with the Department of Labor. An LCA contains information about the employer, job titles, proposed wages, work locations, and employment duration.

H-1B Visa Classification
The H-1B visa is for foreign workers in specialty occupations that require theoretical or technical expertise. Eligible specialty occupations typically require a bachelor's degree or higher (or equivalent) as a minimum entry requirement.
H-1B visas are subject to an annual numerical cap of 65,000 regular visas, with an additional 20,000 visas for beneficiaries with a master's degree or higher from a U.S. institution. H-1B workers employed at universities, non-profit research organizations, or government research organizations are exempt from this cap.
Employment Requirements and Protections
Employers must attest on the LCA that they will pay the worker the higher of the actual wage paid to similarly employed workers or the prevailing wage for the occupation in the geographic area of intended employment. They must also provide working conditions that will not adversely affect other similarly employed workers.
H-1B status allows for initial stays of up to three years with possible extensions, generally limited to a maximum total stay of six years. Extensions beyond six years may be available in certain circumstances for individuals who have started the permanent residence process.
